Banele Ginindza POWER utility Eskom might just have to whistle for its outstanding R36 billion debt owed by municipalities after the Constitutional Court ruled as irrational and unconstitutional its decision to cut off power to defaulting municipalities. The land mark decision involving the Emalahleni Municipality and the Thaba Chweu Local Municipality dates back to a December 2019 decision by the Supreme Court of Appeal that Eskom’s decision to interrupt bulk electricity supply was irrational as Eskom knew it would not result in the financially strapped municipalities settling their debt.
