THE Constitutional Court has confirmed the ruling of the Pretoria High Court that the Executive Ethics Code was unconstitutional and invalid. In a unanimous judgment on Tuesday, Justice Steven Arnold Majiedt said the Executive Ethics Code was inconsistent with the Constitution and invalid to the extent that it did not require the disclosure of donations made to campaigns for positions within political parties. “The code falls short of constitutional and statutory dictates of transparency, accountability and openness,” he said. “The exclusion from disclosure of donations for internal party elections undermines the Ethics Act and the conflict of interest regime that is essential to promote transparency and to deal with the pervasive corruption bedevilling us,” Majiedt said. A 22-year-old man has been sentenced this week to life imprisonment for the murder of Bongekile Nandipha Khema, the secretary of a ANC branch executive committee in Durban. Siphamandla Enoch Ngcobo was also convicted in the Durban High Court of conspiracy to commit murder, two counts of attempted murder, and unlawful possession of a firearm and ammunition. Khema, who was also a tuckshop owner, of Quarry Heights, was killed in April 2019. She also worked as an assistant to the councillor in ward 11 which includes Quarry Heights, Newlands East and New Dawn Park. A magistrate has issued warrants of arrest for a grandfather and grandmother convicted of being part of a sex ring, which involved the rape, sexual grooming of children, and distribution of child pornography, should they fail to appear for sentencing on December 1. Pretoria North Magistrate Pieter Nel issued the warrants as he indicated on Monday that no medical evidence was shown in court. KAMPALA: An outbreak of Ebola has been declared in Uganda after health authorities confirmed a case of the relatively rare Sudan strain, the health ministry and World Health Organization (WHO) said yesterday. A 24-year-old man in Uganda’s central Mubende district showed symptoms and later died. The health ministry said the confirmed patient had high fever, diarrhoea and abdominal pains and was vomiting blood. He had initially been treated for malaria. YORK TIMBER Holdings’ headline earnings per fell sharply to 9 cents in the 12 months to June 30, from 40c a year before after heavy rainfall affected its operations. Directors said in the results yesterday they had to temporarily close down all operations at its sawmill in Graskop during the year due to the sawmill being dependent on South African Forestry Company (Safcol) for log supply. Volumes awarded by Safcol were significantly less than bid volumes. With no raw material security, a decision was made to temporarily close down the operation. THE Road Freight Association (RFA) says the call to ban the movement of trucks on major roads during the day was badly informed and posed a far greater risk of accidents due to lack of visibility at night. The Pietermaritzburg High Court has handed down lengthy jail terms to two men convicted of the murder of a farmer in the Creighton area of KwaZulu-Natal. PARLIAMENT is closer to finalising the repeal of the apartheid-era Expropriation Act after the public works and infrastructure portfolio committee on Tuesday adopted the bill and its report for tabling in the National Assembly. However, one opposition party threatened to take the Expropriation Bill to the Constitutional Court to determine its constitutionality before it is signed by the president. The bill, which was introduced in Parliament in October 2020, seeks to provide a framework to guide the processes and procedures for expropriation of property by organs of state for a public purpose or in the public interest. WITH the 2021 Interpol African Cyberthreat Assessment Report indicating that South Africa was leading in digital extortion, online scams and business email attacks, private security companies have called on government entities to strengthen their cybersecurity efforts. The latest victim of a cyberattack is the South African Post Office, which, according to private cybersecurity company Mimecast, had witnessed more than 100 000 fraudulent emails imitating the entity. Moss Gondwe, public sector director at Mimecast, said their threat-hunting team had picked up that there had been a resurgence of email scams imitating the Post Office between May and June this year. COMPANIES that damage municipal infrastructure while digging up pavements in eThekwini Municipality to install fibre or other products, may soon have to face the consequences as a new city by-law has been proposed.
